By accessing this website, submitting an inquiry, or booking services with Vexonix Corp (“Vexonix”), the Client agrees to be legally bound by these Terms. No services will be performed without acceptance.
Vexonix provides aerial data acquisition, photogrammetry, inspection, and related services. All services are subject to operational, environmental, and regulatory limitations.
3. REGULATORY COMPLIANCE
All operations comply with Transport Canada CARs Part IX and applicable airspace authorizations. Vexonix may delay or cancel operations where safety or legal compliance is compromised.
Services are weather-dependent. Vexonix may reschedule due to weather, GNSS limitations, interference, or safety concerns. No liability is assumed for such delays.
Client must provide accurate site details, ensure lawful access, and disclose hazards. Failure may result in cancellation or additional charges.
Deliverables include orthomosaics, 3D models, point clouds, and reports. These are data representations and not certified surveys unless explicitly stated.
Deliverables are not a substitute for licensed surveyors or engineers. Client is solely responsible for verifying data before use in construction, engineering, or legal applications.
No third party may rely on Vexonix deliverables without written consent. Unauthorized reliance is at the Client’s sole risk.
Accuracy depends on environmental conditions, equipment, and methodology. Vexonix does not guarantee absolute precision unless explicitly contracted.
Payment terms are defined per project. Vexonix reserves the right to suspend services or withhold deliverables for non-payment. Late payments may incur fees.
Cancellations within 24–48 hours may incur charges. Mobilization costs are non-refundable once incurred.
Deliverables are deemed accepted if no written dispute is submitted within 5 business days of delivery.
Vexonix retains ownership of all raw data. Client is granted a limited, non-transferable license to use deliverables for agreed purposes only.
Vexonix is not liable for data loss, corruption, or incomplete outputs due to hardware, software, or environmental factors.
To the fullest extent permitted by law, Vexonix shall not be liable for indirect, incidental, or consequential damages, including loss of profits or project delays. Liability is strictly limited to the fees paid.
Client agrees to indemnify and hold harmless Vexonix from any third-party claims arising from use or misuse of deliverables.
Vexonix is not liable for delays caused by events beyond reasonable control including weather, equipment failure, or regulatory restrictions.
These Terms are governed by the laws of Ontario and Canada.
By booking or engaging services, Client confirms acceptance of these Terms.
